The Statutory Supervisor
The Work Health and Safety (WHS) laws came into effect in Western Australia on the 31 March, 2022.
They comprise the Work Health and Safety Act 2020 (WHS Act) along with three sets of regulations – General, Mines and Petroleum and Geothermal Energy Operations. It is the Work Health and Safety (Mines) Regulations that apply to mining and mineral exploration operations (WHS Mines Regulations).
The Statutory Positions
Schedule 26 of the WHS (Mines) Regs, lists the statutory positions that are required by law, the statutory supervisor (SS) is one of those positions.
The Statutory Supervisor (program) comprises two units of competency from within the Business Services Training Package:
- BSBWHS411 Implement and monitor WHS policies, procedures and programs
- BSBWHS414 Contribute to WHS risk management.
The above units have been chosen by the regulator after much industry consultation and, if embedded well will (1) build the leadership capability of supervisors and (2) enable a sound risk management mindset.
